Terms of Service
These terms are the agreement between you and Burak Ayaz ("we", "us") for your use of Apollo — the Apollo mobile app, web app, and API. By creating an account or using Apollo, you agree to them. If you do not agree, do not use Apollo.
1. Apollo is beta software
Apollo is provided as a closed beta for evaluation and testing. This matters, so please read it carefully:
- Features may change, break, or be removed without notice.
- Your data may be deleted. We reset beta environments during development. Learning progress, notes, and generated content may be lost at any time, and we do not guarantee backups.
- There is no uptime commitment, service level, or support obligation.
- We may end the beta, or your access to it, at any time.
Disclaimer — our postal address is incomplete. The address in section 17, and in the Privacy Policy, names a district but no building, so post addressed to it will not reach us. Apollo is run by one person rather than a company, and a complete address would be a private home; a deliverable one will be published before Apollo is offered to anyone beyond the closed beta.
Email is the working channel and we treat it as binding — support@apolloapp.site for account and service matters, privacy@apolloapp.site for data rights. This does not narrow any right you have under these terms or applicable law, including any mandatory consumer protection in your country of residence (section 15); it tells you which route works.
If you do not accept this, do not use Apollo — including during the closed beta. If you have already registered, email privacy@apolloapp.site and we will delete your account and data.
The full explanation is in the Privacy Policy.
2. Eligibility
You must be at least 16 years old to use Apollo. Access during the closed beta additionally requires a valid beta key issued by us. Beta keys are personal — do not share, publish, or transfer them.
3. Your account
- Provide an email address you control, and keep it accurate. We use it for verification, password resets, and important service notices.
- Keep your password confidential. You are responsible for activity under your account.
- Do not create multiple accounts to work around beta limits.
- Tell us promptly at support@apolloapp.site if you believe your account has been compromised.
4. Acceptable use
You agree not to:
- Scrape, bulk-download, mirror, or systematically extract Apollo's learning content, catalogue, or generated material.
- Redistribute, resell, sublicense, or publish Apollo's content, whether or not modified.
- Reverse engineer, decompile, or attempt to derive source code, except where that restriction is prohibited by law.
- Access the API by automated means beyond ordinary use of the app, or in a way that degrades the service for others.
- Probe, scan, or test the security of the service without our written permission, or circumvent authentication, rate limits, or beta gating.
- Use Apollo unlawfully, or to upload unlawful or infringing content.
Good-faith security research is welcome — please coordinate with us first at security@apolloapp.site.
5. Content you create
Notes you write remain yours. You keep all rights you already have in them. You grant us a non-exclusive, worldwide, royalty-free licence to host, store, reproduce, and process that content strictly for the purpose of operating Apollo and providing the service to you. This licence ends when you delete the content or your account, except for copies retained transiently in backups.
You are responsible for the content you create and for having the rights to it.
6. Our content
Apollo, its software, design, curriculum structure, lesson text, exercises, and audio are owned by us or licensed to us, and are protected by copyright and other laws. We grant you a personal, non-exclusive, non-transferable, revocable licence to use Apollo for your own language learning during the beta. No other rights are granted.
Apollo incorporates third-party dictionary and linguistic data under open licences. Those sources, and the licences that govern them, are listed on our attributions page. Where a third-party licence grants you rights in the underlying data, that licence governs that data.
7. Third-party integrations
If you connect a third-party service such as WaniKani, your use of that service is governed by its own terms and privacy policy. We are not responsible for third-party services, and connecting one is at your own discretion. You can disconnect at any time.
8. Feedback
Beta feedback is genuinely valuable to us. If you send us suggestions, bug reports, or ideas, you grant us an unrestricted, royalty-free, perpetual right to use them to improve Apollo, with no obligation of confidentiality, attribution, or compensation. You are not required to send feedback.
9. Suspension and termination
You may stop using Apollo and request account deletion at any time by emailing privacy@apolloapp.site, or through the app once in-app deletion is available.
We may suspend or terminate your access if you breach these terms, if required by law, or if we discontinue the beta. On termination, your licence to use Apollo ends and we will delete your data as described in the Privacy Policy.
10. Disclaimers
Apollo is provided "as is" and "as available", without warranties of any kind, whether express, implied, or statutory, including any implied warranty of merchantability, fitness for a particular purpose, accuracy, or non-infringement, to the fullest extent permitted by law.
Apollo is a study aid. We do not warrant that its linguistic content, translations, readings, or generated stories are accurate or complete, and some content is machine-generated. We make no promise about your performance on the JLPT or any other examination. Do not rely on Apollo as your sole source for consequential decisions.
11. Limitation of liability
To the fullest extent permitted by law, we will not be liable for any indirect, incidental, special, consequential, or punitive damages, or for any loss of data, learning progress, profits, or goodwill, arising out of or relating to your use of Apollo.
Because Apollo is provided free of charge during the closed beta, our total aggregate liability to you for all claims relating to Apollo is limited to the greater of JPY 5,000 or the total amount you have paid us for Apollo in the twelve months before the claim.
Nothing in these terms excludes or limits liability that cannot be excluded or limited by law, including liability for death or personal injury caused by negligence, or for fraud. If you are a consumer, you keep any mandatory statutory rights your local law gives you.
12. Indemnity
You agree to indemnify us against claims, damages, and reasonable costs arising from your breach of these terms, your misuse of Apollo, or content you upload that infringes someone else's rights. This does not apply to consumers where local law prohibits it.
13. Apple App Store
If you obtained Apollo through the App Store or TestFlight, you acknowledge that: these terms are between you and us, not Apple; Apple has no obligation to provide support for Apollo; Apple is not responsible for any product warranties or for addressing any claim relating to Apollo, including product liability, legal compliance, or intellectual property claims; and Apple and its subsidiaries are third-party beneficiaries of these terms and may enforce them against you.
14. Changes to these terms
We may update these terms as Apollo develops. We will update the effective date above, and for material changes we will notify you by email or in the app. Continuing to use Apollo after a change means you accept the updated terms.
15. Governing law
These terms are governed by the laws of Japan, without regard to its conflict-of-law rules. The Tokyo District Court has exclusive jurisdiction as the court of first instance, except that if you are a consumer you may also bring proceedings in the courts of your country of residence, and mandatory consumer protections there continue to apply.
16. General
If any provision is held unenforceable, the rest remains in effect. Our failure to enforce a provision is not a waiver of it. You may not assign these terms; we may assign them in connection with a merger, acquisition, or sale of assets. These terms, together with the Privacy Policy, are the entire agreement between us regarding Apollo.
